Meet the Attorney

Randy Emory Started on the Insurance Side

Randy Emory graduated from UNC at Chapel Hill in 1985 and went to law school at North Carolina Central University. After law school he worked in State Farm's claims department for three years, where he handled over three thousand auto claims and saw how an insurance company handles the claims it receives. In 1991 he took that knowledge to an established personal injury firm in Charlotte, where he worked for ten years. In 2001 he started The Emory Law Firm. He has handled over 16,000 auto claims during his career.

After a Serious Truck Crash

Three Things That Protect Your Claim

In North Carolina one finding of fault can bar a claim, and a trucking company has to keep some key records for only months.

  • 1. Get Care and Keep Every Record See a doctor right away and keep every bill and report. Bodily injury claims can include doctor and hospital bills, lost wages and pain and suffering.
  • 2. Get the Names and the Crash Report Write down the company name on the truck, the driver, the insurer and any witnesses. NCDMV takes crash report requests on form TR-67A, by mail or in person.
  • 3. Call Before You Give a Statement Talk to a lawyer before you give a recorded statement to the trucking company's insurer. Fault decides so much in North Carolina that your own words matter.

FAQ

Frequently Asked Questions

Still have questions? Call (704) 371-4333, Monday to Thursday 9am to 5pm and Friday 9am to 4pm.

Talk to the Firm
  • Does The Emory Law Firm handle truck accident cases?

Yes. Truck accidents, wrongful death and catastrophic personal injury are among the services the firm lists. Start with the truck accident page, then call (704) 371-4333.

  • What does Randy Emory's State Farm background mean for my case?

He worked in State Farm's claims department for three years after law school and handled over three thousand auto claims there, so he knows how an insurer handles the claims it receives. That does not predict the result in any case. It is the perspective he brings to an injury claim.

  • I might be partly at fault. Should I still call?

Yes. North Carolina's contributory negligence law can bar a driver found partly at fault from collecting damages, so how fault gets decided matters a great deal. An adjuster's view is not the last word: a disagreement over negligence may have to be resolved in court.

  • How long do I have to file after a truck crash in North Carolina?

Generally three years for personal injury under G.S. 1-52(16) and two years for wrongful death under G.S. 1-53(4). Other rules can apply to your case, so do not wait to find out which ones do.
